Terms of Service

1. Acceptance of Terms

The REIHub service (“Service”) is offered only to users located in the United States and Canada. By accessing or using the Service, you represent and warrant that you are located in the United States or Canada, and you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, or if you are not located in the United States or Canada, do not use the Service.

We may update these Terms from time to time. We will use reasonable means to notify you of material changes (e.g., in-app notice or email to your account). For material changes that reduce your rights or increase your obligations, we will provide at least 30 days' notice when practicable before the change takes effect, unless the change is required by law or for security. We will also post the updated Terms and update the "Effective" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

2. Eligibility and Account

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify us of any unauthorized use of your account.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms and any applicable laws. You may not use the Service to harass others, post false or misleading content, scrape or copy data without permission, circumvent access controls, or interfere with the operation of the Service. We may suspend or terminate your access if we believe you have violated these Terms or our community standards.

4. Communications

By opting in to receive SMS (e.g., in your profile settings), you agree that we may send you transactional text messages only (e.g., password resets, login alerts), as described in our Privacy Policy. We use a dedicated line for transactional messages only. You may opt out at any time by updating your profile or replying STOP. Message and data rates may apply.

5. Your Content and License

You retain ownership of content you post to the Service. By posting content, you grant us a non-exclusive, royalty-free, worldwide license to use, store, display, and distribute that content as needed to operate and improve the Service. You represent that you have the right to post your content and that it does not violate any third party’s rights or applicable law.

6. Our Intellectual Property

REIHub and its logos, design, and technology are our property or our licensors’. You may not copy, modify, or use our branding or technology without our prior written consent.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR AFFILIATES, OFFICERS, AND EMPLOYEES) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your account or access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (including disclaimers, limitation of liability, and governing law) will survive termination.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. Any dispute arising from or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.

11. General

If any part of these Terms is held unenforceable, the remaining parts remain in effect. Our failure to enforce any right does not waive that right. You may not assign these Terms; we may assign them without restriction. These Terms (together with our Privacy Policy and any other policies we reference) constitute the entire agreement between you and us regarding the Service.

We are not liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemic, government actions, labor disputes, or critical failure of third-party infrastructure (e.g., hosting or telecommunications). Such obligations are suspended for the duration of those circumstances.
